1. Sponsorship and Eligibility
This sweepstakes is sponsored by GT’s Living Foods, LLC, P.O. Box 2352, Beverly Hills, CA 90213 (“GT’s Living Foods”). There is no purchase necessary to enter or win. This sweepstakes is open to legal residents of the fifty United States, Washington DC, and Canada who are eighteen (18) years of age or older at the time of entry; however, the sweepstakes is void where prohibited by law. GT’s Living Foods reserves the right to request proof of age or identity. Employees of GT’s Living Foods and its affiliates, licensees, franchisees, advertising and promotional agencies and the immediate family members are not eligible. Immediate family members are a person’s parents, siblings and children. Participants in the sweepstakes agree that they have read, understood and accepted these Official Rules and agree to be bound by them, including all eligibility requirements and decisions of GT’s Living Foods. GT’s Living Foods reserves the right to revise any and all aspects of the sweepstakes and these Official Rules at any time with or without notice to entrants.

2. Qualification Period
The period for submitting entries for the sweepstakes begins at 12:00 AM (Pacific Daylight Time-California) on June 7, 2020 and ends 12:00 AM (Pacific Daylight Time-California) on August 7, 2020. This time period is called the “qualification period” or the “entry period.”


3. Entry Procedures
To enter the sweepstakes, post a dance video of yourself with a @GTsKombucha bottle and hashtag #UnitedWeDance on at least one of your social media accounts: TikTok, Facebook, Instagram, or Twitter.

After you have completed the entry steps, this will automatically give you an eligible entry in the sweepstakes.

4. Duties of Participants; Limitation of Liability; Disputes
By entering, participants agree to be bound by these rules and the decisions of GT’s Living Foods which shall be final and binding. All applicable laws apply. GT’s Living Foods and the employees, officers, directors, shareholders, agents, and representatives of GT’s Living Foods and its affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, web site, social media platform or computer malfunctions, failures, or difficulties; (iii) errors in transmission or reception; (iv) any condition caused by events beyond the control of GT’s Living Foods that may cause the sweepstakes to be disrupted or interrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the sweepstakes; (vi) errors in these official rules or their interpretation or enforcement; or (vii) any printing or typographical errors in any materials associated with the sweepstakes. By participating in the sweepstakes, entrants (or entrant’s parent/legal guardian if any entrant is deemed a minor in the state/province or country of his/her residence) agree to release and agree to indemnify, defend and hold harmless GT’s Living Foods, Twitter, Inc., Instagram, Inc., Facebook, Inc. , TikTok, Inc. and the employees, officers, directors, shareholders, agents, and representatives of GT’s Living Foods and its affiliates, subsidiaries, and advertising, promotion and legal advisors, as well as Twitter (collectively, the “Released Parties”) from and against any and all claims, demands, losses, or cause of action for any damages (including, without limitation, all consequential, punitive, and incidental damages), liability, loss, cost, fees (including attorneys’ fees), including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the sweepstakes or receipt or use or misuse of any prize, and for claims based on publicity rights and intellectual property rights, defamation or invasion of privacy. GT’s Living Foods makes no warranty, representation or guarantee of any kind, express or implied, in fact or in law relating to any prize. This sweepstakes is not sponsored or endorsed by, or affiliated with TikTok, Twitter, Instagram, or Facebook. If, in GT’s Living Foods’s opinion, there is any suspected evidence of tampering with any portion of the sweepstakes, or if technical difficulties compromise the integrity of the sweepstakes, GT’s Living Foods reserves the right to modify, cancel, suspend or terminate the sweepstakes in whole or in part, at GT’s Living Foods’s sole discretion, including, without limitation, revoking any entrant’s entry into the sweepstakes and/or revoking any winner’s prize award.

5. Governing Law; Disputes
Any dispute arising out of or relating to these official rules or this sweepstakes shall be resolved by binding arbitration in accordance with the then current rules of the Judicial Arbitration and Mediation Service. The place of any arbitration shall be Los Angeles, California. Any issues or questions of construction, interpretation, validity, or enforceability of these rules, or the rights and obligations of the entrant and/or GT’s Living Foods in connection with the sweepstakes shall be governed by, construed and interpreted in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rule which would cause the application of the laws of any jurisdiction other than the State of California.

6. Violation of Sweepstakes Rules
GT’s Living Foods reserves the right, in its sole discretion, to (a) void any and all entries of an entrant who GT’s Living Foods believes has attempted to tamper with or impair the administration, security, or fairness of the sweepstakes, and/or (b) disqualify any participant or winner who, in its sole determination, tampers with the entry process, or violates these official rules.

7. Selection of Winner; Chances of Winning
Fifteen (15) winners will be randomly selected by 5:00 PM (Pacific Daylight Time-California) before the following days of the sweepstakes from among all eligible entries received:

August 14, 2020

Odds of winning depend on the total number of entries received once the entry period begins.


8. Description of Prizes
The sweepstakes will be for the following: Total of three (3) prize packages.

Each winner shall receive:
• One (1) Flightgift.com gift card redeemable for airfare (approximate retail value $600)
• Los Angeles Residents Exempt
• One (1) Paid Hotel Room Reservation for 2-night stay in Los Angeles Metropolitan are (approximate retail value $500)
• Standard room rates apply, equivalent to One (1) Standard Double Queen Room or One (1) Standard King Room.
• Room Incidentals not included
• Winners will be notified of hotel destination by August 14, 2020 at 5:00 PM PST (Pacific Daylight Time-California).
• Los Angeles Residents Exempt
• Three (3) 12-pack cases of GT’s Synergy Kombucha (“aka “one month’s supply”), via case delivery or equivalent VIP coupons shipped via United States Post Service.
• Invitation For Exclusive Guest Entry (plus One (1) “Plus One” Guest) to a “Summer Celebration” event at GT Dave’s home (aka “The Kombucha Lair”) in Los Angeles on Sunday August 30, 2020 from 2-6PM PST.
• Date and time of scheduled “Summer Celebration” event subject to change.
• Shuttle from hotel to and from “Summer Celebration” event will be provided.
• Winners will be required to complete RSVP requirements with confirmation of attendance no less than 10 days prior to the event, by August 20, 2020.
• Winners will be subject to Background Checks prior to event.
• Winners will be required to complete all liability waivers and non-disclosure agreements no less than 10 days prior to the event, by August 20, 2020.

9. Notification of Winners; Substitution of Prizes
The winners will be notified via direct message from either of the social media accounts used to submit an entry by 6:00 PM (Pacific Daylight Time-California) on each day a winner is selected, that they are the winner.  GT’s Living Foods reserves the right to use additional means to contact winner, at its sole discretion.  Winner may not substitute or transfer prizes.  GT’s Living Foods reserves the right to substitute a prize of equal or greater value in the event the prizes are unavailable.  Prizes may be subject to reporting for tax and other purposes. Winners should consult their tax advisers with respect to any applicable taxes relating to any prize.  

10. Permissions
Except where prohibited by law, entry constitutes permission to use the winner’s name, hometown city and state, voice and likeness for online posting, and/or any advertising and publicity in any form without additional compensation. Nothing shall obligate GT’s Living Foods to so use or engage in any of the above. Winner (or winner’s parent/legal guardian if any winner is deemed a minor in the state of his/her residence) may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize. In such a case, an alternate winner will be selected at random from the eligible entries.

11. Privacy
Subject to applicable privacy laws, all entry information collected may be used for GT’s Living Foods’s internal purposes and to send information to entrants about GT’s Living Foods’s products, services, and promotions but will not be provided or sold to third parties, except as necessary for the administration of the sweepstakes or legal procedure. By entering, entrants (or entrant’s parent/legal guardian if any entrant is deemed a minor in the state of his/her residence) agree to these Official Rules in addition to the “Privacy Policy” of GT’s Living Foods which are found at the following URL: http://gtslivingfoods.com/privacy-policy/.

12. Severability
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
